For anyone that has or currently work for
I've finally have blew my lid on these companies treating us like employees but paying us and not paying us benefits to get over. I've done some researching, I had a 30 min conversation with the IRS yesterday and after going over my job description and what I do, YES WE ARE EMPLOYEES!!! The lady I spoke with said that I should pass this information onto everyone that works for this company and a few others.

If you are so unhappy about your situation with this company or any others then quit & try finding a job working outside the home that's going to give you the flexibility working at home gives you. There always have to be people who complain about everything. Get a grip!

I can see where Jamjam is coming from. We have to protect one another. Because you know they aren't gonna do it.
And yea its nice to work from home for us, but its nice for them as well. Companies save a lot of money not having to pay rent on the brick and mortor to house employees. Not to mention equipment, utilities, and supplies. So who does working from home truely benefit, you or your "employer." However with this information, you can now make an educated decision whether you should work for a company that hires ICs but requires you to perform as an employee. Not complaining, but being educated. I think this info was helpful. Thanks Jam. |

That's fine & dandy but start calculating how much you have to spend to work out of the home: childcare, work clothes, lunches, transportation, limited time with your family, etc. I have done both so I know what both sides of the coin are like. As long as I do my job properly I am fine. I don't have anyone breathing down my neck or all the office politics BS. My point is if you read your contract it was clearly stated that you were an independent contractor & that taxes & benefits would not be paid by the company. If you have a problem with the terms of the contract or the fact that these companies have a level of service/professionalism they expect then don't work for them. All I know is I have a steady stream of work coming in, no schedules to stalk for hours & I know on the 8th & 22nd of every month my check will in my bank account like clockwork. Seems to be a lot of people lately are trying to scare people away. I say apply if you feel you would fit what they are looking for because they are a great company to work for. Enough said.

Whats gonna happen is, people like jamjam are going to cause a lot of problems and this company will STOP hiring home workers OR they will lower the pay rate to the Minimum wage where we will still have to pay for the High Speed Internet, second phone line, etc, and its going to become a big cut on our paychecks as we will also have to put our own monies up front each pay period for taxes and get them at the beginning of the next year which will REALLY pinch the budget.
I cannot stand someone who is a whiner and a complainer, and if you dont like the job and dont want the job QUIT! And get another one.....simple as that.... |

Or in Jam Jam defense , maybe enough people do something about these issues and they realize just because you work at home dont mean you will take anything, and they follow rules that is set to protect *Workers* home or not and we get the paid we deserve
The company i work im an ic (and i love it ) so i know no benefits or paid vacation but if i was with a company that treated me as an employee i would feel the same but if companies are going to treat you as an employee you should get the good and bad of being one |

I'm just wondering why this chick is being so got damn rude to me, when I'm only saying and doing something about what it owed to me. If you like your job and the way you are treated, then don't file the SS-8. But there are people that do want to do something about whats going on.
If the company is legit then the IRS won't find them guilty, if they're not then it should be something done about it. I can't stand people that whine about losing their $8 per hour jobs, damn. I simply gave the information for those that were interested. It doesn't even have to be with this company, but with ANY company. A lot people aren't aware of the SS-8 or that it's something that can do to be heard about the mistreatment of employees. But all this rude and bashing is extremely uncalled for. I will now be putting Crystal Glasses on permanate ignore. |

WOW crystal glasses......would not want to have you answer my calls! lol. I think the whole IC thing should be on a schedule we set-not what someone else sets. JMO i know....I mean i read everything about being IC versus being an employee. But Jam Jam, what is the deal? WHy are you so upset about this job/company/position? they were upfront about everything i though. Just curious jam jam. I mean if your not happy with what they offer why take the job? or why complain they offer nothing. the only way u might work at home w/benefits if you work for some personal company or something
and shame on those you jumped down your throat, we are all here for one another, not to cut each others throats! And i Agree with Raquel, there are some advantages and disadvatages to working at home. something to defintely consider when choosing who to work for as well. good night!

big round of applause for knowing how to pose a question or arguement. Here's my position. I'm personally in a position where I HAVE TO WORK FROM HOME. If I want to make any kind of income, working from home is my only option. The thing is, working from home is only going to be moving forward, not backwards. IMO I find it hard to understand how you can have so many companies in the same type business, yet they do thing so different "classification" wise. You have Alpine and Xact for example that hires their workers as employees. You have Willow that requires you to become incorporated. Then you have companies like West and LiveOps that hires you as contractors (which I agree we should be, based on the IRS rules), then you have places like Voice Log and Sterling that too hires you as contractors, but yet the have all of these strict rules and "set" schedules. IMO out of those 3 senarios, somebody doing something wrong, and the only people that are sufferring from it is "us." This can't continue to happen. These companies are making big $$$ money off of us, these companies are SAVING a lot of money as well. If not for "us" there is no way this entire work from home process could ever work, yet companies only think about themselves and their wallets. I can completely understand and accept things if maybe they were paying us $10 - 12 per hour. But hell, I can't even afford insurance. I was food posion a while back and now have a medical bill almost $3000 from going to the ER. This is unacceptable. Even at $8 per hour, that isn't even including the taxes I will be paying out, the cost of computer access, utilites, rent, phone bills, food, and gas just to get around for daily running around. I can only imagine how hard it will be if I had children. Lets get serious here. So YES!!! Of course, if it's even a inkly of a possiblity that any of the companies I have worked for owes me "back" pay towards taxes ect, you damn right I'm going to go after them. It's not even so much about me. It's about people to come who will want to work from home. I think the IRS needs to be aware of this new trend that's on the rise, and start setting some type of special something... I don't know what, but something for those that are working from home. Start imposing some type of rules on these companies. But to answer your question. Yes, I knew what I was getting into from the very beginning but hey I needed the money. Although $8 per isn't a lot money it's better than working on a per min rate and never knowing what I'm going to make one week from another. I was PO'd when they explained the whole "submit your avalibilty" and someone will set your hours for you. The sh!t is wrong, period. Not as a independent contractor are you suppose to be making a schedule for me. So I'm going to just get legal on they butts. It's that simple. |

Also I want to add we should really be getting reinbursed for the cost of internet and phone services. All the "real" independent contractors that I know are reinbursed for any cost they inccur by completing a job for a company. If you ever notice contruction worked, truck drivers, and other professionals ALWAYS ask for their receipts whenever they purchas gas, lunch, and anything else they buy to do a job for a company.
I was just listening in on a call on Ho*els.com for WorkingSol and a guys was telling the Rep that he didn't know if he should purchase through Ho*els, because he was a contractor and would need to be reinbursed by the company. He didn't know if they would pay him if he used a discount service type of thing. If anyone wants to be technical about it. If you want to be even more technical, based on the IRS guidelines. If I wanted to go out and hire 10 people to do my job with Voice Log, West, or Live Ops I should be able to do it and their nothing they (the companies) should or can do about it. Take a contruction company that aquires a $100,000 project from the Government to rebuild a highway overpass. If that same construction companies goes out and finds another company that will do it for $60,000 there is nothing the Government can say about it. Based on the IRS rules, if you a employer hires you as a independent contract they CAN ONLY TELL YOU THE DESIRED RESULTS of the contract or job. However the CAN NOT tell you how to accomplish it. |

I really dont mean to SOUND RUDE, its just that people like jamjam are really causing a bunch of drama over what THEY see as some injustice, and soon the companies will just say oh well....you can work at a facility in some such city and state and no one will be home workers anymore due to this drama.....and I am VERY VERY polite and respectful to ALL of the customers that call in no matter HOW rude they may act to me at times, but on this forum I THOUGHT I HAD AN OPINION TOO!! WHOOPS!!!
And...about the SET schedule.......WE are the ones who say...I CAN WORK from (example) 2pm - 10 pm est or 1pm -5pm and 8pm -11pm or whatever.....and then the computer actually puts out a schedule for the workers that are available, the hours available etc, if we were to all say well I dunno when I can work, HOW IN THE WORLD WOULD THEY KNOW WHO IS WORKING WHEN?? And then if lets sy only 1 or 2 people show up, how can that person handle all the calls that are coming in? Then the customers would all be put in ques, and then VL would LOSE the CONTRACT for thos ecompanies, that NEED their calls verified...and then there would be no company and NO JOBS!!! How can anyone?? I mean ANYONE expect to come and go as they please?? I just DONT UNDERSTAND THAT LINE OF THOUGHT! Quote:

As I stated earlier , I dont mean to sound rude, its just that you sound like you are on your high horse, and I dont wanna lose MY JOB over YOUR ISSUES!! Know what I mean? And ignore me all you want, Ive never sent you a pm, only messages in open forum, I can express myself, I didnt curse at you or call you names or nanny nanny boo boo, I am stating what I believe...Thanks for the option....
And hey, I agree about the hospitalization thing, Im not covered either, BUT you can speak with the Hospital and sometimes if you are in the POVERTY level which you probobly are, I am not being mean, I am there too..........then they can absorb those charges, and they will do that, I go to a clinic to see a DR based on my income, (luckily there is one near me, not all people have that option) and I see them for 5$ a visit, 5$ for each blood test, 5$ for each thing they do for me, and I am daggone lucky ...I get my High Blood Pressure meds for 10$ for a 3 month supply and without them, Id be in danger of stroke, heart attack or death so, I am greatful, believe me I am veryyyyyyyyyyyyyyyyyy greatful! And Im sorry if I sounded mean, I am just in fear of losing my own job and being n a worse situation than I allready am, thats all. Id be up a creek without a paddle without this job, and to go find a new one now......man, it takes a month to get a paycheck and its usually for a weeks worth of work, so there goes gas $$ at 3$ + a gallon etc.... So yah, Im a bit stressed over this stuff......... Quote:

Jam-Jam honestly I do understand what you are saying but understand this these jobs are a choice not a sentence and for many a solution to a major problem in their life. How do I bring in income without paying an arm and a leg for childcare and my child calling the daycare worker "momma". Believe me I believe in fighting for justice but on this one you must understand that their nothing to fight. We can't force them to pay benefits and take out taxes when we signed contracts stating that we were aware and accept this fact. You could take that to the Supreme Court and you wouldn't have a leg to stand on. Those of us who found these jobs and LOVE IT because of its flexibility do not want someone to mess it up because they are fighting the unfightable battle, ON THIS ONE! JamJam just save it for a real injustice thats all I'm saying. I'm a single mother who was trying to live on a teacher's salary with a house. I need jobs such as this one and I have a TEENAGER
who I dare not leave alone for long periods of time to go work some outside job to make the ends meet. Ya know!! These jobs are heaven. |

lol no I mean we all do what we can do for our familys. maybe looking for other opportunities while with the position you have would be better. there are many diff places/ops out there. maybe you can find one more suitable. But none of the places i ahve seen offer any ins or anything. you would prob have to purchase your own. look on the internet and see what you can find. also-if income is not hat much for you seek help from your state (food stamps etc) we al do what we have to do to survive. I do not feel that there is any thing that can be done with getting lawyers after this company. how you gonna pay for that? and secondly if any lawsuit were possibly you might put others out of work for a job they like. Keep looking for other positions. I work with w*ll*w and i do w*lgr**ns right now. i can pick my hours and everything. i make my own schedule. maybe you really need to find a company to accomodate your needs better for your schedule. there are some opps thet pay TT and sales incentives etc....u just gotta keep looking. offer your services to local businesses or what not (depending on what you can do) to offer working for them at home and maybe you can get a business to hire you and provide ins as well good luck to you all.

Thanks Malibu!!! But I don't want you to get me wrong. First off, it's not my intentions to file a lawsuit or anything. It's not even necessary, the IRS will determine if there is a miscalssification of employees/contractors. It's that simple. Any company that is found to misclassify there workers will have to pay steep penalities as well as back taxes into all of the workers tax accounts. So I'm not trying to file a lawsuit or anything.
Secondly, I'm happy with the company and what I do. But when someone is wrong about something, they're wrong. I'm not hurting for any money or anything I have 2 jobs from home including Voice Log. I work Voice Log full-time and Working Solutions part-time. I also have 2 little extra income things that I do like US Monitor and Key For Cash. So I'm doing alright finacially. Everything well be alright. For those that feel so strongly against what I'm doing, for those that have their feet planted firmly supporting this company let the best person conquer. Surely people aren't trying to support a company that is breaking the law. |

Hi All I was reading the posts here and just wanted to add, as IC's you can take off the expenses phone, computers, and even a part of your home for use of a computer room or that for your business on taxes, so there is the reimbursement part.
As far as us having benefits, I find it a benefit to at least work at home, and be able to schedule my job and take a vacation and/or other time off as needed when I want to.. Yah granted some of the IC's places want you to work only the scheduled hours they post and such, but so be it, work the sched. hours needed or that, and work your appts and such around it. Also depending on the state you are in... there is help with the gov't for medical bills you cannot afford to pay.. as far as medical and dental insurance goes, it is hard for anyone to afford this even a working person outside the home..but at gas going up to 3.00 gal and some areas 4.00 gal.. and daycare in Maine is non existent here now with all the closures of jobs and we don;t have work in our area to speak of, outside the home, I rather just be at home working for a living... no commute and no worries.. no daycare.. having to dress up and do a 9-5 outside the home.. but on medical bills there is help for that out there.. you just have to ask around and find it.. But as far as some of us being employees, if they don't remove taxes i don't see how we can be.. and yes we do have schedules to follow but it is best to do that then everyone on the 1pm shift and no one on the 1a shift, a matter of organization and balance.. it is nice to be informed of this and yes it can go with any company out there, but there are loopholes and stipulations too with the IRS and most companies that can still make us IC's rather then employees.. when it comes right down to the nitty gritty of things.. that is just my 2 cents on the whole topic.. again, JamJam thank you for the information. but trust me most companies they will have a loophole someplace, to keep the IRS from saying that we are employees... whether they pay hourly or by the time on the call, if they are not removing taxes, they consider you a self employed person bottom line.. i know cuz my hubby in same situation with his company outside the home, he was an IC and had a schedule daily and worked till the job was done, and they removed no taxes, but.. removed child support... yet he was an IC go figure.. that one ![]()

Nothing wrong with someone trying to improve their situation.
I'm sure West (who I work for) has a team of lawyers far smarter than I am, or will ever be. I was presented with an opportunity. I read it over, thought about it. (*I chose to accept it as stated to me.) Now I can decide I don't like the way things are going, so I'm going to get the government involved. The government can't do anything right, it can't even efficiently run itself. It could come in, twist Wests arm, and cost them millions of dollars in legal fees, fines etc... West is a mulyti million dollar company. They are worldwide. They have ic's and call centers located all over the world. I'm the CEO of West. all of a sudden I see my company having to pay huge fines, etc... Costs have skyrocketed. But only in my US operations. What do I do? shut it down, and shift everything to India where I can get workers for $5.00 a day. I saved West millions, West stock shoots up. bottom line IC's are a dime a dozen, and expendable/replaceable. You want good workers, but not if they are costuing you more $$ than they are worth. no offense to anyone, it's just the way things are. As long as IC's are profitable there will be plenty of work fo IC's. But if that changes... It's supply and demand. It's capitalism. Besides, since I chose to accept this job knowing full well how it operated. I would think I'd be partially liable for any money owed to the government, if there is any. I pay my taxes, Uncle Sam is getting all that's due to him.

Hi folks!
I work seasonally at a rather large tax prep company owned by a family member. I've seen exactly what the IRS can and will do. First of all, please understand that the IRS does have a hotline you can call to report people for not paying their taxes and there is monetary compensation involved. I know that doesn't apply here, but it gives you an idea of exactly what the IRS will do. Now, here's the thing: it doesn't matter if we argue until we're blue/green/purple about the IC/Employee thing because the fact is, in some cases, they're breaking the law. No one can argue with that, because the tax law clearly states it. I had one of our preparers find the information for me. The real question is, will the IRS do anything about it and how would it affect us? Here's the next thing: Ethically, this is a lot like kids on a playground, playing baseball. There are set rules for baseball, but if you've ever seen kids play, they don't always follow those rules and sometimes make up their own. The question is, first, is it ok for the kids to not be following the rules? What if someone gets hurt because they weren't following the rules? What if the kids are no longer allowed on that playground because of it? Secondly, if Johnny goes and tells the teacher that his teammates aren't following the rules, has he broken their trust and "told on them" or has he saved them from getting hurt in the long run? I'm not trying to exhibit bias in either direction, but I am trying to set this up as a representation of an ethical situation (hehe, I'm the ethics person at my seasonal job, too) that everyone can understand. Basically, it's just to make it easier to look at the situation and ask, "OK, what do *I* think?" ![]() |

I think there is a need for some kind of standard these companies should be held to... laws were put into effect in many instances where some would readily work for companies regardless... some would ( and still do) work without being paid minimum... when children were not allowed to work anymore... you can bet there were those that would be more than willing... The laws were put into place to protect workers and companies... but there just needs to be some kind of specific guidelines... Just because some will work for below minimum does not make it right... Or the willingness of workers to work in unsafe conditions.... just because someone will do it... doesn't mean they should be allowed to...
Go into any place that has employees and they need to have a Material Data Safety Sheet for all chemicals used and stored... each needs clean up instructions... It is like that because SOME of the workers took it upon themselves to make it better for the rest. Yes being a stay at home mom is great... but they should make companies get on the same page with this.... I am not saying that all of these companies need to pay taxes and offer benefits..... but you can't really argue the fact that there needs to be improvement. Yes we can write off our purchases and expenses...thank goodness... But if they are allowed to... some companies will continue to move toward treating ICs like employees...except for whatever benefit there would be for the IC. I don't think all work at home jobs will go the way of the Dodo just because they are given standards to work by. So many callers already complain about overseas outsourcing that the trend will most likely just start hurting companies... there are always those that fight minimum wage increases with the same argument... workers will be let go if we have to pay them more... well the garbage will continue to be there... people will continue to need coffee at coffee places... roads will have to be plowed in the winter( okay in the winter here anyways) etc...So not having the right number of workers is not an option...companies that say they will go out of business if something like that happens are usually in pretty deep doodoo already and use that for an excuse. When you have custys calling and no one answers... or someone answers they cannot understand... they complain and things change........ More often lately I get callers that just call and hang up until they get someone they can understand...Companies will realize that domestic ICs are a good deal even if they have rules attached to them...it will be gradual. I don't think many will say they want full wage and benefits with the freedom of being and IC... I think that the argument is that if you are not going to be an employee... then you shouldn't be treated like one. Yes some will always break the rules... but if they are caught doing it... there should be penalties. I think the IRS should look at every one of these companies... then pass or fail them. If they are legal... no problem.

i don't work for this company but i felt the need to leave a comment about the lack of benifits and the 8 dollars an hour. i currently work for a call center that i have to drive 40 minutes one way to get to. I'm required to abide by a dress code, follow strict rules, and it doesn't matter if I work 50 hours a week every week forthe rest of my life there i will always be considered a part time employee and never get benifits. they do take taxes out of my pay, but thats it. I can't afford health insurance either. i can barely afford the gas its taking to drive to work. If I could afford the 600 dollars its going to take to get my groud line turned back on I would work for this company or any other company contractor or employee or not!

I don't work for this company but do work for another company where I'm considered to be an ic JamJam let me just thank you for providing the information that you provided for us to look over. Not one time did you say we had to get involved you just simply was trying to share some info that you got with the rest of us that are considered to be ics not just for this company but many other companies out there. I'm a work at home wife and mom with 5 teenage daughters and a disable husband in a wheelchair it a pleasure to be able to work from home so that I can take care of him and be here for them as well. not all of them are living in the same house with us but they call on me more than they do anyone else so I have to be here for them,not to mention that I have health issues myself now here the deal with me yes I took on the responsibility of being an ic. and the money was good at 1st, the hours were available, I was saving money then have to worry about buying clothes,buying either a monthly clayton county transit card along with a monthly marta card that would cost me about 104 dollars a month to do so. I considered it a blessing on that note you know we are always so quick to say what there are benefits out there for those that are in need of medical insurance and other things well let me tell you going into these places to apply for benefits is not the easy the workers treat you like you are trash beneath their shoes now don't get me wrong not all of them are like that, some can be pretty understanding and are really doing all they can to help. Now I don't know what can and can't be done to company that treat us like employees but say that we are supposed to be ics. I'm not into trying to put anyone out of business or to make any other ics suffer from fear of losing their jobs. but if we can take a stand to make some changes that are benefictal to all of us I say go for it. In my opinion there is a plus and a minus side to be an ic. Here are the plus side. 1.we don't have to worry about paying gas or public transportation,2 those that have kids don't have to worry about daycare. 3 don't have to worry about spending a fortune on clothes to wear to work, 4. save money on lunch,5 can take time off work when ever we need to do so and also take vacations. Now here is my list of minuses. 1.No type of medical,dental or vision care benefits(yes i know i can go to my local dfacs and apply).2. Losing money when their system is acting up and no one saying well because you showed up for work, we will at least give u something for your time, 3.signing into work with no cv and not getting one red cent for your time. 4. having the amount of taxes u have to pay back to be just almost as much as u made. Like I said there is ups and downs in being an ics and hey for that matter an employee. I don't think we should be making JamJam feel bad for expressing how she felt about these issues and the information she gave cause she was only in my opinion being helpful someone may need this info and may find it helpful lol me personally don't understand nothing concerning the IRS lol. We are here to help one another so when another poster provides us with information we shouldn't be so quick to tear that person down about it. we can either take it or leave it imo if someone doesn't see that info will benefit them then hey move on to the next post but if you do then I say make notes of the valuable info that is given by all of us wonderful board members that are willing to bend over backward to supply that info. JamJam took a big responsibilty in posting that information for us she could of easily lost her job over that but she didn't care about that at all her biggest concern was looking out for the rest of us and she did not only for the people working for this company but for those of us working for the other company and for that I just want to say thank you very much. Please guys we got to stop this jumping down each other throats it not cool at all. So I'm going to start right here by saying I apologize to anyone that I ever disrespected,jump down your throat or anything else that wasn't cool that I did. let learn to get along cause like it or not we are all in this together. I want what best for everybody and just cause we can work from home it doesn't mean we got to do the work of 40 peoples and get paid pennies for our time. we deserve to be treated with respect and to get paid for our time no ifs,ands or buts about it.
